Please read the following terms carefully as recommendations to Stonehewer Moss Limited by any means not limited to but including its web sites means that you agree to them.
- PAYMENTS
The Claimant (injured person) must be the person who makes initial contact with us with details of their accident claim. This initial contact must be made using the form on this web site. If we take down or accept information relating to a potential claimant from a third party introducer then no recommendation fee can or will be paid. By agreeing to these terms and conditions, you are authorising us to make the recommendation payment to the person or organisation that recommended you to us.
All recommendation payments can only be paid once the claim has been accepted by our us and has been given approval as a genuine claim. A single recommendation payment of £250 per case will be made once the Insured 3rd parties representatives have admitted liability for the accident and we believe that costs of at least £500 will be recovered from the Defendant. Only one recommendation payment will be made per case. The Recommendation fee cannot be made to the injured person.
The payment will only be made if, the introduced person was already looking for legal help in making a claim for injury prior to being recommended and is also the person who contacted us with details of their claim and asked that the introducer be paid the recommendation fee. In the event the introduced person does not agree to the recommendation payment being made to the introducer or does not declare that they were already intending to make a claim, then we will be unable to make any recommendation payment.
We will not make any payment in relation to any recommendations where we are already acting or in the following circumstances:
- There is already (or has been) a firm of solicitors acting
- The claim arises out of a criminal assault
- Cases involving injuries caused by animals
- The case arises out of a claim for ‘whiplash’ or similar soft tissue injury.
- The claim arises as a result of a road traffic accident where compensation for injury is unlikely to exceed £5,000
- Unless we are instructed under a ‘no win, no fee’ agreement with a success fee payable by the Claimant and an overall cap on our costs of no more than an amount equal to 25% of damages recovered (18% in cases where the amount received exceeds £25,000)
- Untraced driver or uninsured driver claims
- Where the injured person is not the person who first contacted us with details of the claim
- Where the injured person is, at the time of our instruction, a protected party or a child under the age of 18
- Where the injured person was not intending to make a claim prior to ourselves being recommended
- DATA PROTECTION AND PRIVACY
Any details which you provide to us from which we can identify you are held and processed in accordance with our privacy policy. If you provide details of a third party you are confirming that the third party has requested you to provide those details to us and has requested that they are contacted by us. All data held by us will be destroyed after 6 years either from the end of the case or from our notification that we cannot accept the case.
- BREACH OF CONTRACT
By recommending a friend to us you are confirming that the recommendation is made honestly and in good faith. In the event that after investigation we discover that we have been misled then we reserve the right to recover from you any payment we may have paid together with damages for our losses. We will also refer the matter to the police for investigation.
- CHANGES TO THE TERMS
Stonehewer Moss Limited may change the site or these terms at any time. After we have changed the terms you will be bound by the new terms.
- GOVERNING LAW AND JURISDICTION
These terms and your use of this site are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.
