A Simple Guide to Skin Injury Compensation

A skin injury can be incredibly painful, irritating and can significantly affect a sufferer’s body confidence. There are many ways in which the skin can be damaged due to the negligence of a third party, these injuries tend to take the form of burns, scalds, lacerations, scars and dermatitis.

Burns and scalds are some of the most common types of skin injury we see. Many of us handle or are exposed to hot water on a daily basis when we boil pans of water on the stove or flick the kettle on.

Those who work in kitchens are at particularly high risk of injury, as their working environment is usually quite tight with many people navigating the space whilst holding hot pots and pans as well as sharp knives. Fortunately, the law is structured to protect those who have suffered an accident at work through no fault of their own and so should you have suffered a burn, laceration or scald skin injury at work you may be able to make a claim.

People who work regularly with harsh chemicals are more likely to suffer from a skin injury like Dermatitis/ Eczema, particularly if they have not been provided with adequate protective equipment for when they are handling the substances. Contact Dermatitis is a skin injury brought on by the exposure to an allergen or irritant (like dust or chemicals), which causes the skin to burn, become itchy and turn red.  Dermatitis can be extremely debilitating and in severe cases may make it difficult for you to work in the same role as you had prior to the skin condition.

We are unfortunately very aware of the impact a skin injury can have on someone’s personal and professional life. Thankfully, with the years of knowledge and expertise our team have in handling this type of claim, we have already been able to help many clients obtain the compensation they deserve.

How much is your skin injury claim worth?

The figures shown below are provided as guidelines. In order to determine a more accurate valuation of your potential injury claim, it is recommended that you speak with one of our solicitors.

  • £8,000 – £18,000 – Troubling Dermatitis
  • £1,000 – ££4,000 – Less Troubling or Short Lived Dermatitis

What are General and Special Damages?

The compensation calculator can help you estimate the out of compensation you might receive for your injury claim. This part of your compensation is known as General Damages, as it relates to the pain, suffering and loss of amenity that you have suffered as a result of your accident.

  • Pain: refers to the initial pain you suffered when your accident occurred.
  • Suffering: refers to the ongoing pain that you have endured since the accident.
  • Loss of amenity: refers to the fact that you could either for a period, or permanently no longer do something that you could do prior to the accident, for example play a sport.

The compensation calculator does not include other losses that you might have incurred as a result of your accident. Such as, loss of earnings, cost of care or damage to property. These items are known as Special Damages and can be claimed in addition to the General Damages mentioned above. The amount of compensation you receive will ultimately be made up of General and Special Damages, that is your injury claim and financial losses.
