How to find out the value of a personal injury claim.
Dominic Moss, senior partner here at Stonehewer Moss solicitors, briefly details the considerations when valuing a personal injury Claim.
I often get asked right at the beginning of meeting somebody what do you think it is worth? What do you think my claim is worth? And that is really one of the hardest questions to answer because, very often there are always a lot of things to think about when valuing a claim.
In other videos I have discussed the difference between general and special damages which are the injury type damages and the financial type damages. When I meet someone for the first time is is very rarely clear whether they are going to lose their earnings, for example, or they could have a care claim, or an assistance claim or anything else. Also, it is often difficult to decide how long the injury itself is going to last. So, if you’ve broken your ankle is it going to recover perfectly within 6 months or are you going to have problems for the rest of your life. So, it is not an easy task to say what my claim is worth. I do try to give guidance. I have been doing this job for 20 years, so I have seen most situations more than once, but it is not an exact science and it does depend on the evidence as it comes out.
If you’ve got a load of documentation with medical reports and all the rest of it and you’ve got no idea what your claim is worth, and you want someone independently to look at that for you and give you an idea. You might be with another solicitor; you might be dealing with it yourself; but if your in that position please do not hesitate to give me a call.
