A no-win, no-fee, no success fee claim is when a claimant pays only the solicitors basic charges without any additional success fee on winning a personal injury claim funded on a ‘no win, no fee’ basis.

Hi, my name is Dominic Moss from Stonehewer Moss Solicitors. Today I wanted to talk about what do we mean by ‘No Win, No Fee, No Success Fee’. Many solicitors will charge you a success fee on top of the fees that they would normally charge you, which we call “Basic Fees”, if they win your personal injury claim. Now in many cases this money is a lot more than solicitors actually probably justified in the sense of how many hours they’ve worked in taking. For example, if you have a claim that settles quite quickly, the solicitor hasn’t had to do much work to get the payment in for you. Also, if you have a claim where the value is very high, 25% plus VAT(which is the sort of figure people charge for success fee) might be an awful lot of money of a big value claim. Many tens of thousand pounds or even more than that. So here at Stonehewer Moss we don’t always charge a success fee, that doesn’t mean you’re not liable to pay our basic charges, but we limit your liability to our basic charges to no more than 18% plus VAT of the compensation that you recover. So, if you’ve got a claim where you expect to recover over £100,000 (that’s quite a moderate to large size claim) your liability for your legal costs would be no more than £20,000. And in the event it settles quickly and the legal costs weren’t that much and we got that money back from the other side, your actual liability could be an awful lot less. So, there are circumstances where instructing us you would save yourself many tens of thousands of pounds.
