- The wedding ceremony revokes any current will; you may wish to have a will in place to cover the period immediately after the wedding, say because you have dependant children and are due to fly overseas for the honeymoon.
- A will in anticipation of marriage to a specific person is not revoked by the wedding if correctly drafted;
- A mutual will agreement evidences that the survivor of the two of you is taken to hold the assets inherited from the other spouse on trust to dispose of by their own will as anticipated by the wills;
- A pre nup cannot exclude the court in divorce but the courts are increasingly likely to impose the terms of an agreement if entered without undue pressure, with open disclosure and independent advice.
Timescales for negotiation of the pre nup at a civilised pace need to be taken into account when planning your wedding.
