Practical legal steps to take before your wedding day

Practical legal steps to take before your wedding day  in Cheshire. The union of a couple in marriage has profound legal consequences and some planning before the wedding day will help ease stress in future years. Northwich solicitors Stonehewer Moss have put together  a basic package of a will each made in anticipation of marriage, a mutual will agreement and a pre nup. Family solicitor Michael Brennan explains that each document has value for the couple, as follows:-

  1. The wedding ceremony revokes any current will; you may wish to have a will in place to cover the period immediately after the wedding, say because you have dependant children and are due to fly overseas for the honeymoon.
  2. A will in anticipation of marriage to a specific person is not revoked by the wedding if correctly drafted;
  3. A mutual will agreement evidences that the survivor of the two of you is taken to hold the assets inherited from the other spouse on trust to dispose of by their own will as anticipated by the wills;
  4. A pre nup cannot exclude the court in divorce but the courts are increasingly likely to impose the terms of an agreement if entered without undue pressure, with open disclosure and independent advice.

Timescales for negotiation of the pre nup at a civilised pace need to be taken into account when planning your wedding. Michael recommends planning for legal work before the wedding should be included in your wedding lists of things to do at least two months before the day. Care should be taken deciding which process to use to negotiate an agreement should that be called for. For example, Michael Brennan is a collaborative practitioner and the round table approach of that process could be ideal to iron out any issues without pressure; Michael is a member of collabfamilylawcheshire, a group that seeks to foster trust and better communication between family lawyers.
