The offender does not necessarily have to have been convicted of, or even charged with the crime for you to make a claim. However your claim could be affected by your behaviour, your criminal record, your failure to co-operate with the police, or if you have delayed making the claim.

You must report the assault to the police at the earliest opportunity and an application to CICA for compensation must normally be made within two years of the assault. However, in exceptional circumstances, the authority may be willing to extend this limit. An example would be if you are making a claim for assaults you suffered as a child.
