Pregnancy-related dismissal

Have you been dismissed on the grounds of pregnancy or maternity rights?

If you are pregnant, you cannot be fairly dismissed for any reason connected with your pregnancy, such as:

  • Giving birth and being dismissed during your ordinary or additional maternity leave
  • Taking or wanting to take, ordinary or additional maternity leave
  • A health and safety issue that could result in you being suspended from work
  • Not keeping in touch with your employer during your maternity leave

It would also be unfair dismissal if your employer dismisses you because you returned to work late from maternity leave because they didn't tell you properly when your leave ended…

or…

they gave you less than 28 days notice of the end date of your maternity leave, and it wasn't possible for you to return to work at that time.
